Units in charge of implementing actions for compliance with Resolutions 98 and 99 of the Ministry of Communications in the different territories

The Technical Budget Unit for Radio Spectrum Control (UPTCER) and the Territorial Control Office (OTC), are the entities of the Ministry of Communications in charge of implementing actions in the territories to comply with Resolutions 98 "Regulations for the Use of High Speed Wireless Telecommunications Networks in the 2.4GHz and 5GHz Frequency Bands" and 99 "Regulations for Private Data Networks" of 2019. In agreement with the process of informatization of society, aimed at enabling the organization, operation, and use of private data networks, allowing to extend their reach to natural persons, contributing to improve the welfare of citizens and protect the sovereignty of the country.

The territorial control offices control and supervise the fulfillment of the regulations in force in the areas of telecommunications, radio communications, information technology, postal and automatic as well as the execution of the company's informatization program.

The UPTCER ensures the sovereignty of the radio spectrum, manages the permission-granting process associated with telecommunications/ICT systems and services.

Chapter III (Resolution 99, Article 20) establishes that the Territorial Directorates of the UPTCER, will be in charge, as of 7/29/2019, of the reception of the requests for granting, renewing or modifying the operational licenses of the networks, having a term of up to thirty workdays to grant these licenses, after accepting the requests that comply with the established requirements; the authorized Private Data Networks will be registered at the Central Internal Administrative Control of the Ministry of Communications.

Article 34 (Resolution 98, Chapter IV) establishes that natural persons require a technical authorization issued by the UPTCER for the importation of non-commercial equipment, provided that they operate in the frequency bands from 2400 MHz to 2483.5 MHz and from 5725 MHz to 5850 MHz and whose maximum transmission e.r.p (effective radiated power) can be adjusted so that it does not exceed 100 mW, which they will request in accordance with the established procedures; if they do not have the technical authorization for importation, the equipment is retained and they will proceed in agreement with the current legislation.
